Intel?s Cable TV Service And Set Top Box Will Soon Roll Out City By City

Intel TV ControllerIntel?is preparing to launch its rumored virtual cable TV service and set top box, and has a plan to overcome licensing hurdles. Rather than roll out nationwide, the launch will happen on a city-by-city basis so Intel has more flexibility in negotiating licensing with reluctant content providers, according to a video industry source. The Intel box may also eliminate a core frustration with DVRs.

Study links milk-producing protein to aggressive breast cancer

HONG KONG (Reuters) - The discovery that a protein which triggers milk production in women may also be responsible for making breast cancers aggressive could open up new opportunities for treatment of the most common and deadliest form of cancer among women.

Found in all breast cells, the protein ELF5 tries to activate milk production even in breast cancer cells, which does not work and then makes the cancer more aggressive, according to scientists in Australia and Britain.

"The discovery opens up new avenues for therapy and for designing new markers that can predict response to therapy," said lead author Professor Chris Ormandy from the Garvan Institute of Medical Research in Sydney.

In 2008, Ormandy's work linked ELF5 to milk production.

The latest research by Ormandy and his team, published in the journal PLOS Biology on Friday, went a step further to find the link between ELF5 and breast cancer.

"Cancer cells can't respond properly (to ELF5), so they ... acquire some characteristics ... that make the disease more aggressive and more refractory (resistant) to treatment with existing therapies," Ormandy said by telephone.

Ormandy and his team grew human breast cancer tissues, genetically manipulated to contain high amounts of ELF5, in petri dishes and saw how the protein proliferated aggressively.

FINDINGS MAY HELP TARGETED THERAPY

Breast cancer is the most commonly diagnosed cancer and the top cause of cancer death among women, accounting for 23 percent of total cancer cases and 14 percent of cancer deaths in women.

To decide on treatment, doctors normally need to find out if the cancer has receptors for the hormones estrogen and progesterone, which, in the case of breast cancer patients, promote growth in their tumors.

Two-thirds of breast cancers are usually positive for estrogen receptors, which then require anti-hormonal therapies that lower estrogen levels in the patient or block estrogen from supporting the growth of the cancer.

For the remaining one-third of patients, their cancers do not have receptors, which means they won't benefit from hormonal therapies. Such patients are usually given other treatments, such as chemotherapy.

Ormandy's team found that cancers with these receptors had low levels of ELF5, while those without receptors had significantly higher levels of the protein.

"What we have shown in this paper is high ELF5 tumors are dependent on ELF5 for their proliferation and if we block ELF5 in high ELF5 tumors, we will block proliferation and that will treat the tumor," Ormandy said.

"If we can develop a drug that targets ELF5, it will be very useful for that group of women," he said.

5 Most Salient Points in Financing a Ground Lease | Metropolitan ...

By Brandon Wilhite

ground-leaseAt Metropolitan Capital Advisors (?MCA?), a commercial real estate capital intermediary, we are continually tasked with assisting our clients in financing challenging projects.? Financing a ground lease, in which the lender?s mortgage is typically not secured by a fee interest in the real estate but rather by the borrower?s leasehold interest in the real estate, certainly qualifies as a challenging assignment as ground leases are notoriously difficult to finance.

A ground lease can be an effective way for a developer or end-user to gain long-term control of land (a ?leasehold interest?) that a fee owner may otherwise not sell.? Such is the case when private property is being developed on public land that is not available for sale or when a private interest wants to retain long-term fee ownership in the land to eventually sell or, perhaps, to create an annuitized income stream to pass down a generation.? In fact, many holiday shoppers may be surprised to know that Northpark mall in Dallas was originally developed on a ground lease, as is the World Trade Center in New York (owned by the Port Authority).

While one could conceivably write a book (or a least a chapter or two) on the ins and outs of financing ground leases, we will just touch on the most salient points in this blog post.

First and foremost, as previously stated, the leasehold mortgage is secured not by the fee interest in the real estate but by the borrower?s leasehold interest in the real estate.? Therefore, in order for the ground lease to be financeable, it must have certain attributes that give a prospective lender adequate protection of its collateral.? In fact, the lender?s biggest risk is not a default by the borrowerbut a premature termination of the ground lease.? Such an occurrence would completely wipe out the lender?s collateral, giving it little recourse to recover the loss of principal.? It is, therefore, crucial that the ground lease give the leasehold mortgagee (the lender) rights and remedies similar to those afforded to real estate-secured lenders in the event of a borrower loan default.? The rights and remedies will typically include the right, without the landlord?s consent, to:

 • foreclose and sell the tenant?s leasehold estate and interests
 • assume the borrower?s lease
 • assign or sublease the assumed lease to a third party
 • cure the tenant?s default ? ideally, the ground lease cannot be terminated by a default by the tenant that is curable by the leasehold mortgagee
 • enter into a new lease under the same terms and conditions as the original lease, if the ground lease is terminated by the landlord, so long as the leasehold mortgagee pays all back rent due

Additionally, in order for a ground lease to be financeable, it must have significant remaining term.? Lenders may require that the ground lease extend anywhere from 10 to 20 years beyond final maturity date of the loan so that the borrower will be able to refinance the loan at maturity.? In fact, in some states certain regulations will put requirements on the loan term as it relates to the remaining lease term? (i.e. ten years beyond the lease term or less than 4/5 of the remaining lease term).

Finally, in some instances it may be necessary for the landowner to agree to a subordinated ground lease in order for the prospective ground lessor to obtain the necessary financing, as opposed to an unsubordinated ground lease in which the leasehold estate is the primary security for the loan.? In a subordinated ground lease, the landowner allows the lender to place a lien against its fee simple interest in the land to secure the payment of the loan.? The lender will have a lien against both the fee simple interest in the real estate and the leasehold estate of the tenant.? In some cases, such as when the land is owned by a public entity (i.e. the Port Authority), this may not be feasible.

Although there are typically more hurdles associated with financing ground leases, so long as the lender is given rights and remedies similar to that of a real estate-secured loan, those hurdles can certainly be cleared.? If you have a ground lease in need of financing or refinancing, contact one of MCA?s Senior Directors to assist you in locating the best financing source. Or, if you would like, please fill out the form below, and we will contact you shortly regarding your financing needs of a ground lease or if you are needed a commercial real estate deal funded:

N.Y. woman charged in slaying of firefighters

WEBSTER, N.Y. (AP) ? A 24-year-old woman was arrested Friday and charged in connection with the Christmas Eve ambush slaying of two volunteer firefighters responding to a house fire in upstate New York.

Dawn Nguyen of Rochester faces a state charge of filing a falsified business record, State Police Senior Investigator James Sewell said. Nguyen also faces a federal charge; a news conference with the U.S. attorney in western New York was scheduled for 4 p.m. Friday.

Sewell said the state charge is connected to the purchase of an AR-15 semiautomatic rifle and a 12-gauge shotgun that William Spengler had with him Monday when firefighters Michael Chiapperini and Tomasz Kaczowka were gunned down. Three other people were wounded before the 62-year-old Spengler killed himself. He also had a .38-caliber revolver, but Nguyen is not connected to that gun, Sewell said.

The .223-caliber Bushmaster rifle, which had a combat-style flash suppressor, is similar to the one used by the gunman who massacred 20 children and six women in a Newtown, Conn., elementary school earlier this month.

Nguyen and her mother, Dawn Welsher, lived next door to Spengler in 2008. On Wednesday and again on Friday, shortly before her arrest, she answered her cellphone and told The Associated Press that she didn't want to talk about Spengler. Her brother, Steven Nguyen, told the Democrat and Chronicle newspaper of Rochester that Spengler stole the guns from Dawn Nguyen.

A number listed in the name of her lawyer, David Palmiere, was disconnected.

Spengler set a car on fire and touched off an inferno in his Webster home on a strip of land along the Lake Ontario shore, took up a sniper's position and opened fire on the first firefighters to arrive at about 5:30 a.m. on Christmas Eve, authorities said. He wounded two other firefighters and an off-duty police officer who was on his way to work.

A Webster police officer who had accompanied the firefighters shot back at Spengler with a rifle in a brief exchange of gunfire before the gunman killed himself.

Spengler spent 17 years in prison for killing his grandmother in 1980 and was barred from possessing weapons as a convicted felon.

Investigators still haven't released the identity of remains found in William Spengler's burned house. They have said they believe the remains are those of his 67-year-old sister, Cheryl Spengler, who also lived in the house near Rochester and has been unaccounted for since the killings. The Spengler siblings had lived in the home with their mother, Arline Spengler, who died in October. In all, seven houses were destroyed by the flames.

Investigators found a rambling, typed letter laying out Spengler's intention to destroy his neighborhood and "do what I like doing best, killing people."

He had been released from parole in 2006 on the manslaughter conviction, and authorities said they had had no encounters with him since.

Facebook Is Wikipedia's Most Popular Article Of 2012: Hot Topic Or ...

What was the most viewed article on Wikipedia this year? The one about Facebook. Is Facebook really that popular of a Wikipedia topic? Perhaps, but more likely, confused searchers are getting to the Wikipedia page rather than Facebook itself.

Yesterday on Toolserver.org, a service of Wikipedia Germany, lists of? the Top 100 most viewed articles for 2012 were released. The data mining was done by Johan Gunnarsson, a computer science student in Sweden.?Rankings for 35 different Wikipedias (by language) are available.?You can find all of the lists here.

Here?s a look at the Top 10 most viewed articles on the English Wikipedia during 2012.

1. Facebook 32,647,942 Views

2. Wiki 29,613,759 Views

3. Deaths in 2012 25,418,587 Views

4. One Direction 22,351,637 Views

5. The Avengers (2012 film) 22,268,644 Views

6. Fifty Shades of Grey 21,779,423 Views

7. 2012 phenomenon 20,619,920 Views

8. The Dark Knight Rises 18,882,885 Views

9. Google 18,508,719 Views

10. The Hunger Games 18,431,626

The 100th most viewed article ?Stephen Hawking? with 7,177,539 views.

Aside from the popular culture of the day (One Direction, The Dark Knight Rises, The Hunger Games, etc.) it?s likely that the two most viewed articles included many visits from confused users who for one or more of many reasons landed on the page.

Why?

In several of the articles I?ve seen since these lists were released the most likely answer is confused users. I concur.

On AllThingsD, Liz Gannes gets input from Jay Walsh, a Wikimedia spokesperson:

First, that users are typing Facebook into an integrated search engine in their browsers intending to go to the site and end up on Wikipedia (which could be a self-reinforcing habit based on search history).

And second, as Walsh put it, ?It?s quite possible that these numbers confirm general, high-level interest and curiosity about top Web properties ? their history, policies, background, etc.?

There is tendency for those of us who live and breathe search and information retrieval 24x7x365 to think of these people as simply confused, lost, ?out of it?, or as seen in a headline from a news service provided by a major search provider, ?dummies?.

A couple of weeks ago Experian announced that the most popular search term of 2012 was Facebook. Some of the other most popular search terms for the past two years include:

 • YouTube
 • Craigslist
 • eBay
 • Yahoo

While some or even a lot these ?navigational? searches are likely from people who don?t have the page bookmarked (if they even know that you can bookmark) or want enter those same letters into the navigational bar directly I think we?re also seeing some of the same confused users we?re pointing out at Wikipedia.

Nothing New

Being able to identify what are most likely sizable amounts of confused and uneducated users in year-end rankings is nothing new.

For example, seven years ago I wrote that the most popular search terms for 2005 on Dogpile included Google, Yahoo and eBay. What made this even more interesting and illustrated confusion about how search works is that Dogpile included results from Google and Yahoo at that time.

Taking a look back at the most viewed articles on Wikipedia during 2008 and 2009 we also see some of the same articles on this years list.

The most viewed Wikipedia article on the 2008 and 2009 lists was ?Wiki?. This year, it?s number two.

 • Facebook was the 5th most viewed article in 2008 and 10th in 2009
 • YouTube was the 2nd most viewed article in 2008, 5th in 2009, and 12th this year.
 • Google was the 21st most viewed article in 2008, did not appear on the list in 2009, and 9th this year.

The bottom line is that what we?re seeing in 2012 is far from new. In fact, it?s a very old issue and confused users should be a concern.

The entire industry and several related professions needs to do more to develop a more web and digitally literate Internet users. It?s not possible to reach everyone but that doesn?t mean we can?t reach some, even a few.

It?s not that nothing is being by the industry along with school, library, and government projects but rather more needs to be done by all of us.

Just taking a few minutes to share a few pointers with your nieces, uncle, or neighbor can make a difference. Everyone is a searcher these days or at least they think they are. Saving people time, effort, and aggravation can turn you into a hero.

By the way, it?s not only the most basic browser, navigation, and search but also, perhaps most important, having some skills to judge the quality (currency, accuracy, source, etc.) of the info people find on the web.

So, next time you come across statistics that show what are most likely confused users try to keep your head shaking and scratching to a minimum and ask yourself how can you contribute to make these people educated to how the web and web tools work.

Brattleboro Reformer: Legislative preview: Energy, health care and ...

Reposted from Brattleboro Reformer.

BRATTLEBORO ? State Sen. Peter Galbraith is not a fan of industrial wind power in Vermont.

About to embark on his second term as a Democratic Windham County senator, Galbraith said he wants to impose a moratorium on development of turbines on state land while also allowing affected communities to have more say in such projects.

?This is an issue that certainly will be a major source of debate,? Galbraith said.

He was among the Windham County state lawmakers who gathered recently at the?Reformer?for a discussion about the upcoming legislative session, which begins Jan. 9.

They expect the legislature to tackle big topics including the environment, health care and energy. One of the most-discussed issues was education, with state Rep. Valerie Stuart saying the state must do more to promote readiness for kindergarten, college and careers.

The Democrat from Brattleboro?s District 1 cited statistics including the fact that, when reaching kindergarten age, only 56 percent of Vermont children are deemed sufficiently ready for those classes.

Stuart, who hopes to again sit on the House Education Committee, also said post-secondary education is becoming increasingly important.

?Over three-quarters of the jobs of the future will require some sort of college education,? she said.

State Rep. Ann Manwaring, a Wilmington Democrat representing Windham District 6, called for a ?bottom-up? approach to education?policy that would emphasize policies that are working on the local level.

When it comes to educational results, ?the needle isn?t moving very much, no matter how much we pay for schools,? Manwaring said. ?I believe we really need to look at education as a system.?

Overall, she added, ?we have to put public education and the success of it at the same level that we?ve put health care.?

That?s a reference to the state?s continuing effort to enact a centralized, single-payer health-care system by 2017. Galbraith said he is concerned that the debate about how to pay for such a system could be ?kicked down the road? to future sessions.

?Unless you figure out how to pay for it, you really haven?t created a system,? he said.

The legislators addressed a variety of other issues including:

? On the energy front, Galbraith believes encouraging greater energy efficiency is a much more effective tool for addressing climate change than wind power.

?Industrial wind in Vermont is about making a statement that we care about global warming at the expense of our ridgelines, when in fact we?re doing nothing about global warming,? Galbraith said.

He wants to introduce legislation that would impose a moratorium on developing industrial-size wind turbines on state-owned land. Also, he wants to require that any such development would need the consent of affected communities.

That includes not only those towns that would host turbines but also those that are situated nearby within view of the towers.

?You need to define what is an ?affected community,?? Galbraith said.

? Encouraging economic development hinges on such initiatives as broadband expansion, workforce development and creation of affordable housing, said state Rep. John Moran, a Wardsboro Democrat who represents the Windham-Bennington House district.

Moran wants a ?worker-friendly State of Vermont? that offers livable wages.

?If you work and you still can?t afford to live, there?s a problem there,? he said.

? Moran also wants to encourage ?open and responsive budgeting? at the state level.

?It will give us a (better) sense of how we?re allocating our resources,? he said.

? State Rep. David Deen, a Westminster Democrat representing the Windham 4 district, chaired the House Fish, Wildlife and Water Resources Committee in his last term.

Deen said he is interested in issues including storm-water management, pollution in the Connecticut River watershed and the controversial potential for transporting ?tar sands? oil through the state.

?There will be legislation dealing with transmission of tar sands through pipelines in Vermont,? Deen said.

? About 16 months after Tropical Storm Irene struck Vermont, the Federal Emergency Management Agency ? and its perceived shortcomings ? still is on many legislators? minds.

?I am going to put a spotlight on them and do some public hearings,? Deen said.

? State Rep. Tristan Toleno, a Democrat who will be serving his first term representing Brattleboro?s District 3, said food issues, health and fitness and obesity are among his concerns.

? State Rep. Carolyn Partridge, a Democrat from the town of Windham who represents the Windham 3 district, chaired the House Agriculture Committee during her previous term.

She remains interested in issues including Farm to Plate and the mandatory labeling of food containing genetically modified organisms, or GMOs. Previous efforts to pass a GMO-labeling bill have failed.

If Chuck Hagel Won't Be Secretary of Defense, Who Will Be?

Will President Obama still choose Chuck Hagel, the suddenly embattled former Nebraska senator, as Leon Panetta's successor at the Pentagon??Several?different?comments?came back to haunt Hagel since his name?surfaced?as the "likely" cabinet nominee, but over the long holiday weekend the opposition expanded from familiar Republican faces?to a growing chorus.?On Meet the Press,?New York senator Chuck Schumer declined to say whether he endorsed Hagel's nomination, and while Politico's Mike Allen is already calling Hagel "toast," The Atlantic's Robert Wright and others quite rightly say the decision is still "in Obama's hands."

RELATED: Chuck Hagel Is Sorry for Calling Another Potential Appointee 'Aggressively Gay'

Still, Hagel's foes have planted enough doubt to make the confirmation process tenuous, maybe even impossible. It's "fair" to say he's looking at other candidates, National Journal?reports.?So if the president looks elsewhere, who are?the alternatives? According to?The Hill, Obama has two names in his back pocket, should Hagel's nomination continue its downward slope: Mich?le Flournoy and Ash Carter, both veterans of the current Department of Defense administration. Flournoy previously served as the Under Secretary of Defense for Policy between 2009 and early 2012. She also co-founded the Center for a New American Security, a sort of joint-operation (as described by Michael Hastings) between the media and the Department of Defense. Carter, meanwhile, currently serves as the Deputy Secretary of Defense, but early speculation has focused almost exclusively on Flournoy.?The New Republic's Molly Redden points out:

Flournoy's apparent supporters now include the?Weekly Standard?s?Bill Kristol?(who essentially argued that she wouldn't be as objectionable as Hagel), Romney foreign policy adviser?Dan Senor, and Bush Defense Secretary?Paul Wolfowitz?...

Redden points to this tweet of Senor's:

Isn't it strange that the President dropped Rice but is dug in over #Hagel? Especially when he can nominate the highly qualified #Flournoy

? Dan Senor (@dansenor) December 20, 2012

None of these people, it should also be pointed out, work for President Obama. And President Obama, as administration told? The New York Times well-sourced David Sanger regarding the now official nomination of John Kerry as Secretary of State, had "some discomfort" about a round of cabinet appointments with as high a percentage of old white men as the new House leadership. Flounoy would be the first female defense secretary.

RELATED: This 'Jewish Lobby' Quote Could Ignite a Chuck Hagel Confirmation

Hagel's nomination may still prevail, of course. Four former National Security Advisors wrote a letter to The Washington Post on Christmas titled "In defense of Chuck Hagel,"??and?today's Thomas Friedman column?defends?Hagel's stances toward Middle East policy?and concludes that, while Hagel is indeed "out of the mainstream," such is "exactly why his voice would be valuable right now."?

FDA Backs Safety of Transgenic Fish

Transgenic AquAdvantage salmon grow twice as fast as wild Atlantic salmon. Image: Barrett & McKay Photography / AquaBounty

The first genetically engineered (GE) animal for human consumption?a fast-growing salmon?has come a step closer to the dinner table, with a piece of paperwork posted online on December 22 by the US Food and Drug Administration (FDA).

The FDA?s draft environmental assessment concludes that the fish poses no foreseeable risk to nature. After 60 days of public comment, the FDA may issue a final assessment and approval?at which time AquaBounty, of Maynard, Mass., can begin selling the fish.

However, the draft assessment was dated 4 May, suggesting that the FDA had kept its conclusions under wraps for several months. Advocates on both sides of the issue speculate that political interference may be responsible. ?I think it was controversial, and it was an election year,? says Patty Lovera, assistant director of Food and Water Watch, a Washington, D.C., group opposed to GE food animals. An FDA spokeswoman, Morgan Liscinsky, declined to comment on accusations that the process had been politicized, and says it?s possible that the agency could request further studies after the public comment period.

Delays would not shock AquaBounty's CEO, Ron Stotish, whose company has been seeking FDA approval for the fish since 1995. When he was alerted to the decision today, he didn?t initially believe it. ?I said, ?I?ll wait until I see it because I?ve received calls like this before and it never happened,?? he says. The FDA has reviewed more than 50 safety studies, including one that shows the engineered salmon poses no more of an allergic potential than a wild salmon. The engineered Atlantic salmon contains an active growth-hormone gene from a Chinook salmon that allows it to reach market weight in 18 months rather than three years.

Anti-GE groups still have a long list of concerns. Lovera would like to see more studies done on the potential health risks of the salmon, published in peer-reviewed journals and conducted by scientists with no affiliation to AquaBounty. However, it?s not clear where the money to conduct such tests would come from, as?federal research funding rarely supports GE animals.

The GE salmon are currently kept within enclosed, inland tanks to prevent the small risk that the nearly sterile females will breed with wild salmon. But Lovera still worries that once the fish are approved, manufacturers will file for permits to keep them within nets in the open ocean in order to lower costs. ?This is basically the final step and we think the FDA has given a strong signal that they will accept the fish, and that is a mistake,? she says.

Stotish counters that as part of their application, AquaBounty has promised to not sell the fish to farmers who do not have enclosed, inland tanks. After 17 years and $60 million spent trying to win FDA approval, Stotish is still cautious. ?We are not so foolish to think that this process will suddenly be normal for us,? he says.

Gout study offers genetic insight into 'disease of kings'

Dec. 23, 2012 ? Scientists have shed light on why some people are more susceptible to gout than others. A study has identified 18 new genetic variations that increase levels of uric acid in the blood, which is the main cause of the disease. High levels of uric acid form small crystals in joints and tissues, causing pain and swelling -- the main symptoms of the condition once known as the 'disease of kings'.

Gout is the most common form of inflammatory arthritis, affecting up to two per cent of the world's population. Understanding how these common genetic variants increase uric acid levels in the blood may lead to improvements in the treatment and prevention of the disease. It could also help research into urate-lowering drugs.

The international team of researchers, including scientists from the University of Edinburgh and Queen Mary, University of London, say gout is becoming more common in the developed world.

They attribute its rise in part to increasing levels of obesity and an aging population.

This painful joint inflammation affects at least one in seventy adults in the UK with approximately 900,000 people suffering at least one attack of gout in their lifetime.

The work, published in Nature Genetics, was carried out by analysing the genetic data of more than 140,000 people, from more than 70 individual studies from Europe, the U.S., Japan and Australia and represents the largest study worldwide on this topic.

Dr Veronique Vitart, from the Medical Research Council Human Genetics Unit at the University of Edinburgh, and one of the lead authors of the study said: "Abnormal levels of uric acid have been associated with various common diseases and conditions, but causal relationships are not always clear. Gaining insight into the genetic components of uric acid levels offers a very useful tool to tackle these issues and to further our understanding of these conditions."

Professor Mark Caulfield, from the William Harvey Research Institute at Queen Mary, and a lead author said: "Existing therapies to avoid attacks of gout sometimes cause side effects. Our findings identify new potential mechanisms for gout and offer opportunities for new therapies which may improve prevention of this debilitating condition in the future.

EU to give Spain, France more time to cut deficit: press

MADRID (Reuters) - The European Commission will propose giving Spain, France and several other euro zone states more time to cut their public deficits below the target limit of 3 percent of GDP, newspaper El Pais said on Saturday.

Citing senior Spanish and European Union sources, the Madrid-based daily said France could get an extra year, allowing it to narrow its fiscal gap by 2014, while Spain would be given one or two more years beyond that date.

France said on Saturday that it would maintain its deficit-reduction goal for 2013 regardless of any softer line from Brussels. A Commission spokeswoman declined to comment on the report.

Spain's fiscal targets are to be reassessed in February, EU Economic and Monetary Affairs Commissioner Olli Rehn said last month. No additional austerity efforts are needed until 2014, he added, when more structural reforms are likely to be required.

France does not appear to need additional belt-tightening and may have room for a "softer adjustment", the commissioner also said in an interview with France's Le Monde newspaper on Friday.

But France said on Saturday it planned to stick to its 3 percent goal for next year. "Our public finance path remains unchanged as it was fixed in the autumn," an aide to Prime Minister Jean-Marc Ayrault said.

The French government's 2013 budget is based on a 0.8 percent growth forecast for the year - more optimistic than the flat economic output predicted by Brussels and the International Monetary Fund.

European and Spanish sources had said earlier this month that Spain's fiscal path was likely be loosened to offset the country's second recession in three years.

Such decisions need a formal discussion between the 27 European commissioners as well as a political green light from euro zone finance ministers.

Spain sought support from its European partners this year for its ailing banks, hit by a burst property bubble.

Recession is also undermining government efforts to keep the public debt burden in check, and financial markets expect Madrid to seek sovereign aid sometime next year.

Madrid is to unveil new curbs on index-linked pension payouts and accelerate increases to the retirement age. Both EU demands must be met for Spain to tap international aid, lower its debt costs and fix its stricken economy.

According to El Pais, the Commission has agreed on a new Spanish deficit path of 7 percent of economic output in 2012 and 6 percent in 2013. That compares to current targets of 6.3 percent for 2012 and 4.5 percent for 2013.

Senior Spanish officials told Reuters this month the deficit would probably come in at around 7 percent at year end.

Spain's 17 highly devolved autonomous regions are broadly on course to meet their deficit target of 1.5 percent of GDP, while the central government is heading for a deficit close to 5.5 percent, including social security spending.

HTC One VX unboxing and video walkthrough

HTC One VX

Behold, the HTC One VX on AT&T. More than a One V, less than a One X, and dancing right around the noble One S without giving it as much as a mention in its already convoluted name. We've gone hands-on with the One VX a couple times since it was announced in early October, and it's now available for purchase, having missed its original launch date by a few weeks.

More: Full HTC One VX specs

So what, exactly, is the One VX? In a single sentence, it borrows bits and pieces from the entire HTC One line for a mid-range smartphone that as of now is exclusive to AT&T.

Physically speaking, it's a tad smaller than the One X, but less of a curvy box and more of a sleek and sexy One S. The back is done in the same white polycarbonate shell as AT&T's original One X. (Remember that the One X+ moved to a soft-touch coating.) And the One S is more svelte than the One VX, about 2 mm slimmer, with different curves, and it's a tad shorter and narrower, too. The One VX its between the One S and One X in screen size, too, at 4.5 inches. And while it only has a 540x960 qHD resolution, the move to Super LCD 2 from AMOLED makes a noticeable difference.

Our full review is on the way. For now, hit the break for our HTC One VX unboxing and video walkthrough.

NFL Films? ?They Call It Pro Football? selected for Library of Congress? National Film Registry

1967 PRODUCTION CALLED ?CITIZEN KANE OF SPORTS MOVIES?

FINAL FIVE MINUTES AVAILABLE ON NFL FILMS BLOG

The Librarian of Congress James H. Billington today selected NFL Films? 1967 production ?They Call It Pro Football? for inclusion in the National Film Registry of the Library of Congress.

?Established by Congress in 1989, the National Film Registry spotlights the importance of preserving America?s unparalleled film heritage,? said Billington. ?These films are not selected as the ?best? American films of all time, but rather as works of enduring importance to American culture. They reflect who we are as a people and as a nation.?

The Library of Congress recognized the film as follows in its press release today:

Before ?They Call It Pro Football? premiered, football films were little more than highlight reels set to the oom-pah of a marching band. In 1964, National Football League commissioner Pete Rozelle agreed to the formation of NFL Films. With a background in public relations, he recognized that the success of the league depended on its image on television, which required creating a mystique. ?They Call It Pro Football,? the first feature of NFL Films, looked at the game ?in dramaturgical terms,? capturing the struggle, not merely the outcome, of games played on the field. Written and produced by Steve Sabol, directed by John Hentz and featuring the commanding cadence of narrator John Facenda and the music of Sam Spence, the film presented football on an epic scale and in a way rarely seen by the spectator. Telephoto lenses brought close-ups of players? faces into viewers? living rooms. Slow motion revealed surprising intricacy and grace. Sweeping ground-to-sky shots imparted a ?heroic angle.? Coaches and players wearing microphones let the audience in on strategy and emotion. ?They Call It Pro Football? established a mold for subsequent productions by NFL Films and has well earned its characterization as the ?Citizen Kane? of sports movies.

NFL Films president Steve Sabol long ago made ?They Call It Pro Football? mandatory viewing for all NFL Films staffers. NFL Films named its NFL.com blog after the movie and has posted the final five minutes of the movie for viewing here (http://nflfilms.nfl.com/fact-figures/).

?They Call It Pro Football? joins the ranks of classics on the list including Casablanca, Gone with the Wind, The Graduate, Knute Rockne All American, Lawrence of Arabia, Mr. Smith Goes to Washington, and The Wizard of Oz.

ANALYSIS: As Egypt votes, what is at stake?

Daniel Berehulak / Getty Images

By Ayman Mohyeldin, NBC News

News analysis

CAIRO -- On Saturday, millions of Egyptians are expected to vote in the first round of a national referendum to determine whether the country adapts a new and controversial constitution.

The voting will take place over two days, Dec. 15 and Dec. 22. Ten out of the country's 27 governorates, comprising 26 million voters, will be allowed to vote on Saturday. The remaining 17 governorates and their 25 million voters will be allowed to vote the following Saturday.

Egyptians grapple with political future in controversial vote

Seven thousand judges will supervise the more than 6,000 polling stations on each voting day. The government was required to split the voting over two days because thousands of other judges boycotted supervising the referendum. Officials say voting will also be supervised by observers from civil society, human rights organizations and foreign and domestic media. The U.S.-based Carter Center, however, says it was not able to send an observer to witness the voting process because the regulations required by the Egyptian government were not clarified ahead of the vote.?

Why does the referendum matter to Egypt, the region and the world?
If approved, the referendum would pave the way for a new social contract between the Egyptian state and its citizens. It would replace Egypt's 1971 constitution that had been amended by previous Egyptian presidents to bolster the authoritarian rule that devastated citizens' individual rights.

Keeping options open: Egypt's military maintains watchful eye on politics

Some, however, say the draft constitution changes nothing to curb the powers of the state, and instead opens the door for Shariah law to be strictly imposed. Others say this constitution is groundbreaking because it curbs the powers of the president, limiting his time in office to two terms and upholding the spirit of the 2011 revolution.

Egypt is the largest country in the Arab world, with a population of more than 80 million and great clout over the region. At the same time, Egypt is a vital U.S. ally. The Suez Canal, one of the world's most strategic waterways that connects Asia and East Africa to Europe, lies in Egypt, a country that is also essential to regional stability and is one of only two Arab countries that has a peace treaty with Israel.?

NBC's Ayman Mohyeldin is outside the presidential palace in Cairo where hundreds of thousands are protesting what they say is an unjust constitution. They want to delay a vote on the current draft of the constitution now scheduled for December 15.?

Here's what is at stake in the referendum and what Egypt's draft constitution says about some of the most pressing issues facing the country:

On Islamic law and the role of religion
Egypt's draft constitution states that Islam is the official religion of the state. Supporters of the constitution say the draft allows for the freedom of religion. Article 43 states: "The State shall guarantee the freedom to practice religious rites and to establish places of worship for the divine religions."

Egypt is rapidly approaching its own 'cliff'

Supporters also argue that for the first time, cannons for Christians and Jews will serve as the principals for their personal laws. Opponents of the constitution say the document curbs the rights of religious minorities, including believers of non-monotheistic religions, because it states that the "principles of Shariah Law are the principal source of legislation."

The constitution then proceeds to narrowly define Shariah law as the exclusive interpretation of religious scholars belonging to Al Azhar University, the center of religious and academic learning for Sunnis in the Islamic world. Opponents are also worried about excerpts such as Article 11, which states: "The State shall safeguard ethics, public morality and public order and foster a high level of education and of religious and patriotic values." Critics say that opens the door for a religious take over of civil society and social affairs.?

On the role of the military
The proposed constitution has not changed much in terms of the military's role and function in society. The constitution preserves the role of the Minister of Defense as the commander-in-chief of the armed forces, and maintains that the position be filled from within the institution's officer ranks.

Google+ Hangout from Cairo with NBC News' Ayman Mohyeldin

As such, Egypt's military is headed by a military officer, rather than a civilian. Critics warn this will allow the military to remain powerful and shielded from civilian oversight. The president is the supreme commander of the armed forces, but he heads the National Defense Council. The military's budget remains a state secret and there are no stipulations to force the military to disclose its vast economic empire. Perhaps most troubling, critics say, is that the military would still be allowed to try civilians in military trials.?

On the role of the president
Unlike previous presidents who served for decades at a time, Article 133 in the proposed constitution stipulates that the president will serve for a four-year term with a limit of two terms. Critics contend the new draft constitution preserves "dictatorial powers" for the president, including the ability to appoint judges.

PhotoBlog: Egypt vote sparks violent clashes between Islamists and opponents

The president is also not required by the constitution to appoint a vice-president, which makes the issue of succession somewhat vague. The new draft also prohibits the president from holding any "partisan position" for the duration of the presidency, which supporters say means that once an individual is elected, he must resign from any political party they belonged to.

On women
In the preamble, the draft constitution states that, "equality and equal opportunities are established for all citizens, men and women, without discrimination or nepotism or preferential treatment, in both rights and duties." Supporters of the constitution say the draft gives women new benefits, including support from the state for "widows and breadwinners" and will "ensure maternal and child health services free of charge."

'Men don't have to worry about being caught': Sex mobs target Egypt's women

Critics, however, contend that women's rights are too narrowly defined within the framework of religion and family affairs. They also argue that the strict interpretation of Islamic law could pave the way for limiting the rights of women.?

Other issues stipulated in the draft constitution have also polarized the country, including articles that deal with the freedoms of speech, association and the media.

Supporters and opponents of the constitution have launched massive public awareness campaigns to persuade voters, but come Saturday, it will be the people who will have the final say.?

Crockpot Hot Toddy - Non-Alcoholic Mocktail Recipe - Elana's Pantry

Crockpot Hot Toddy Non-Alcoholic Mocktail Recipe

Healthy Hot Toddies for the holidays offer a cup of pure deliciousness in a sea of junk food.

The perfect drink for your neighborhood Christmas cookie exchange or New Year?s Eve party, I serve these healthy Hot Toddies to both adults and children, and sometimes I make ?em as an after school treat for the boys and the gaggle of friends they bring home.

It is best to start making this spicy, warming drink several hours before you plan to serve it as most crockpots can take time to come to temperature.

Crockpot Hot Toddy

printer friendly

 • 4 quarts water
 • 8 herbal tea bags
 • 1-2 inches fresh ginger, thinly sliced
 • 4 cinnamon sticks
 • ? cup honey
 • 2 lemons, sliced
 1. Place water, tea bags, ginger, cinnamon and honey in a crockpot on highest setting
 2. Steep for a couple of hours until hot
 3. Ladle into cups and add lemons when your guests arrive

Serves?12

When making Hot Toddies, I?ve found it?s best to add the lemon at the end of the cooking process, as the rind can become bitter and over shadow the other flavors in this drink if the lemon is added to early.

I lightly sweeten this healthy beverage so that those looking to limit their intake of honey and other sugars can partake in it. I set out additional honey and stevia for guests (such as my boys) who want a sweeter Toddy.

Here are some of my other favorite warming beverage recipes:

Small businesses already slipping off the - Salt Lake Tribune

Vince Fudzie, CEO of Triune, grabs his hard hat in his office Wednesday, Dec. 12, 2012, in Dallas, Texas. Fudzie, CEO of Triune, a general contracting company based in Dallas, says business with the government has been shrinking since 2006, and the cliff presents yet another challenge. He's already been waiting to find out if he'll get approval to finish a dormitory project for the Department of Labor that's 95 percent complete. (AP Photo/LM Otero)

More than 1,000 miles from Washington, D.C., Marie DeNicola?s small business is already experiencing the consequences of lawmakers? inability to compromise on the budget.

If Democrats and Republicans don?t come to a consensus soon, a combination of billions of dollars in tax increases and budget cuts will go into effect Jan. 1. This "fiscal cliff," as it is commonly being called, is already hurting DeNicola?s company, Mainstream Boutique, a Minneapolis-based chain of 23 franchise stores that sell women?s clothes. DeNicola recently got a painful email from a prospective franchisee who said that she changed her mind about opening a store because of uncertainty about the economic and political climate.

"It was like a punch in the stomach," says DeNicola, who also operates one of the stores. "It?s a little scary ? because of the unknown, small businesses aren?t waiting until January or February to see what happens. People are reacting now."

Going over the cliff could have a range of negative ramifications. If people have to pay higher taxes, they will likely spend less. Businesses will hold off on hiring or making investments that could help them expand. Federal budget cuts will put billions in government contracts in jeopardy. Economists and lawmakers warn that without an agreement, the U.S. could slip back into a recession. And they say that small businesses have the most to lose.

Like her potential franchisee, DeNicola is also holding off on big moves because of the cliff.

"We?re waiting to see what happens before we decide on hiring. I can?t continue to invest in the business until I know what?s going to happen," she says.

One of the biggest concerns for small merchants is the pending expiration of the 2 percentage point cut in payroll taxes that gave consumers more money to spend in 2010 and 2011. If the tax cut isn?t extended, the government stands to get $95 billion ? money that consumers won?t be spending at Mainstream Boutique and other small businesses. Long-term jobless benefits will also expire, giving people who have been out of work for a long time $26 billion less to spend.

The prospect of consumers spending less troubles Greg Jones. The owner of three Five Guys Burgers and Fries franchises in Florida is concerned that customers who might normally stop in three times a week will cut that back to one visit. Restaurants like his lost business to cheaper options like McDonald?s during the recession. He?s worried that will happen again. Jones wants to open two more Five Guys locations, but says he might not be able to if the country goes over the cliff. If his existing restaurants aren?t profitable enough, he won?t get the money he needs to expand.

The consequences that Jones faces are a big part of why Georgia Institute of Technology professor Thomas Boston says he thinks the fiscal cliff could do enough damage to small businesses to halt the economic recovery.

"They?re just now recovering, really growing in any kind of significant way since the recession," Boston says. "The job creation we?ve seen over the last five months, that creation has been located overwhelmingly in small businesses."

story continues below

The stalemate in Washington has kept Arthur Cooper from making big decisions about his Randolph, N.J. Internet marketing company, Optimum7.

"I have to be more defensive in my posture ? I have to hire only based on new business that?s already coming in," he says. "I can?t plan on news business that might happen."

Like many small business owners, one of Cooper?s concerns is the scheduled increase in personal tax rates. He reports his business income on his personal Form 1040 tax return. The scheduled tax increases could result in a much higher tax bill.

"Let?s say I?m going to have to pay $30,000 more for next year in terms of taxes than I did this year," Cooper says. "What impacts me personally impacts my business."

Cooper expects Congress to do what it has done many times in the past ? come up with a stopgap measure and defer significant decisions until six months or more into the future. That would keep him in limbo while he waits to see if lawmakers will eventually agree on taxes and a budget. He?s angry about what?s happening in Washington.

"It?s an embarrassment to the country. It?s an insult to my intelligence," he says.

During the presidential campaign, Republican candidate Mitt Romney contended that small business owners would be hit so hard by the scheduled increase in the top tax rate ? a jump from 35 percent to 39.6 percent ? that they?d stop creating jobs. That rate would affect single taxpayers who earn $200,000 or more and households that earn $250,000 or more. But Democrats and advocacy groups including Small Business Majority say the number of business owners who would be affected by that increase is less than 5 percent.
